Acceptance of Terms
By downloading, installing, or using Local AI (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Buildagon ("we", "us", or "our") governing your use of the App.
Description of Service
Local AI is a fully local AI chat application that enables you to have conversations with AI models running entirely on your device. The App allows you to: - Create and manage chat conversations - Attach and share images and documents - Download and use various AI models - Export and share your conversations - Customize app settings and preferences The App is designed to process all AI operations locally on your device, ensuring your data remains private.
User Responsibilities
By using Local AI, you agree to: - Use the App only for lawful purposes - Not use the App to create, generate, or distribute harmful, illegal, or inappropriate content - Not attempt to reverse engineer, decompile, or disassemble the App - Not use the App to violate any local, state, national, or international law - Not interfere with or disrupt the App's functionality - Be responsible for all activity that occurs under your account - Maintain the security of your device and access credentials You are solely responsible for any content you create, share, or store using the App.
Intellectual Property
Buildagon's Rights: The App, including its source code, design, graphics, and all other elements, is owned by Buildagon and is protected by intellectual property laws. You do not acquire any ownership rights to the App by using it. Your Rights: You retain ownership of all content you create, store, or share using the App, including: - Your conversations and messages - Documents and files you upload - Any other data you generate using the App By using the App, you grant Buildagon a limited, non-exclusive, royalty-free license to use, process, and store your content solely to provide the App's functionality. AI Model Usage: AI models used by the App are downloaded from third-party sources (primarily Hugging Face) and are subject to their respective licenses. These models may have their own terms of use, which you should review before use.
Limitation of Liability
To the maximum extent permitted by applicable law, Buildagon shall not be liable for: - Any indirect, incidental, special, consequential, or punitive damages - Loss of profits, data, use, goodwill, or other intangible losses - Damages resulting from your use or inability to use the App - Damages resulting from unauthorized access to or alteration of your data - Damages resulting from errors, mistakes, or inaccuracies in the App's content In no event shall Buildagon's total liability exceed the amount you paid, if any, to access the App.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to: - Warranties of merchantability - Warranties of fitness for a particular purpose - Warranties of non-infringement - Warranties regarding the accuracy, reliability, or completeness of AI-generated content Buildagon does not warrant that: - The App will function uninterrupted or error-free - The App will meet your specific requirements - Any errors or defects will be corrected - The App is free of viruses or other harmful components AI-generated content may be inaccurate, incomplete, or biased. You should not rely on AI responses for critical decisions without independent verification.
Termination
Buildagon reserves the right to terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination: - Your right to use the App will immediately cease - Buildagon may delete your data stored in connection with the App (note: since data is stored locally on your device, you retain control of your data) - These Terms will remain in effect regarding your use of the App prior to termination You may terminate your use of the App at any time by uninstalling it from your device.
Governing Law
These Terms shall be governed by and construed in accordance with general international principles of law, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in a location mutually agreed upon by both parties.
Indemnification
You agree to indemnify, defend, and hold harmless Buildagon and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: - Your use of the App - Your violation of these Terms - Your violation of any third-party rights - Content you create, share, or store using the App
Modification of Terms
Buildagon reserves the right to modify these Terms at any time. We will notify you of material changes by: - Posting the updated Terms within the App - Sending a notification through the App (if enabled) Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buildagon regarding your use of the App. These Terms supersede all prior agreements, representations, and understandings between you and Buildagon.
